HB Sleep Shaping 2024

Terms of Service

When booking a HB Sleep Shaping consultation with HB Sleep Shaping by Hannah Barclay, the Client agrees to these Terms of Service:

"HB Sleep Shaping" is the trading name of HB Sleep Shaping Ltd. In these Terms of Service 'we', 'us' and 'our' refers to "HB Sleep Shaping".

“Client” means any person or entity engaging HB Sleep Shaping for their services as discussed in these Terms of Service.

General

The Client agrees to follow safe sleep practices in line with SIDS and Red Nose recommendations. Please click here to read more.

The Client understands the safety guidelines on co-sleeping and accepts that HB Sleep Shaping supports safe sleeping practices which supports room-sharing (in their own sleep space, bassinet/cot/bed) and does not support not bed-sharing once the support date commences.

The Client will disclose any medical conditions that their child has prior to commencing sleep support with HB Sleep Shaping.

The Client will not disclose any of the information they receive from HB Sleep Shaping (resources) to a third party without permission.

Client Acknowledgement

The information provided in the sleep intake questionnaire is as accurate as possible the Client’s knowledge.

If the Client’s child has a medical condition, my health care provider’s approval has been sought before commencing a sleep plan.

The Client acknowledges it is the Client’s responsibility to rule out any possible medical causes of sleep problems of their child (such as sleep apnea) as the child

who has underlying medical causes of sleep problems may not be suitable to embark on a sleep plan.

The Client acknowledges it is the Client’s responsibility to ensure their child is gaining weight accordingly, thriving and otherwise well before commencing a sleep support plan.

The Client acknowledges that HB Sleep Shaping is not able to give medical advice and any questions or concerns that I have regarding my child’s health will be under my health practitioners’ care. A sleep plan by HB Sleep Shaping is not intended to replace or substitute medical advice.

The Client acknowledges that HB Sleep Shaping will not be responsible nor liable in any event of injury or adverse events occurring while undertaking a sleep plan. The client is responsible for the safety and health of their child at all times.

Payment

Full payment for all packages or the first installment is required at the time of booking your package. Once the payment or first installment is received in full the Client will receive acknowledgment of payment by HB Sleep Shaping.

Package prices include GST.

HB Sleep Shaping reserve the right to alter prices at any time for any reason.

A sleep plan will not be issued or a consultation will not take place with outstanding invoices remaining. HB Sleep Shaping reserves the right to cancel a consultation if there is an outstanding balance owing at the time of the scheduled consultation.

Any outstanding debt to HB Sleep Shaping will be referred to debt collection agencies.

Payment is to be made in full or in installments via the website.

Refunds

There are no refunds if the client has a change of mind about the sleep service or is unhappy with the service (see Cancellations & Reschedules below).

Cancellations

Cancellations made more than 14 working days prior to a consultation will receive a full refund, less transaction fees.

Cancellations made less than 14 working days prior to a consultation are eligible for the following refunds:

● 50% refund if cancelled prior to the consultation
● 20% refund if cancelled after the consultation
● No refund if cancelled after the consultation or any time during the support

period

HB Sleep Shaping reserves the right to cancel any package prior to the commencement of the home or phone consultation if they deem the package inappropriate for the Client. An alternative package may be suggested and the price difference refunded or the full amount refunded if HB Sleep Shaping or the Client chooses to forfeit the service engaged.

Reschedules

In the occurrence of sickness or critical events, HB Sleep Shaping can reschedule the consultation and cater accordingly.

Reschedules must be made within 30 days of consultation (if the consultation has occurred), or within 30 days of payment.

In the event a support period has commenced and your little one becomes unwell, the support period can be postponed until a time agreed upon by both parties. Upon recommencement of the support period, the remainder of the support period owing will be fulfilled (for example, if the pause occurred 7 days into the support period, 7 days would still be owing to the Client).

Conditions of a Sleep Plan

Individual results may vary and results depend on many matters; including but not limited to, consistency, commitment, personal matters, approach to technique, technique or method, child’s needs, child’s age, severity of situation, following the plan correctly, communication to HB Sleep Shaping and the parents’ desire for change.

A refund is not offered in the event of the client feeling dissatisfied and the client understands that by embarking the plan that this is a risk taken.

Most clients will see results within 7-14 days.

HB Sleep shaping is obligated to keep up to date with current information, research and knowledge surrounding child’s sleep.

The Client understands that the customised sleep plan is meant for their child and only, and should not be shared with a third party. They acknowledge the information might not be suitable for another child.

Any changes the Client makes to their child's sleeping or eating arrangements are their decision and HB Sleep Shaping will only make suggestions for change, of which the Client is responsible for choosing to implement.

It is the Client's responsibility to contact HB Sleep Shaping for any follow up and send the sleep log information through to be assessed for feedback as frequently as suggested.

Upon purchase of a sleep package the Client is agreeing to these terms and conditions and privacy policy as outlined.

Disclaimer

HB Sleep Shaping clients will follow all the Red Nose SIDS safe sleep guidelines.

HB Sleep Shaping does not offer any medical advice, services or treatment to any client. If you have concerns relating to a medical or nutritional issue we urge you to contact your GP, medical professional or pediatrician immediately.

HB Sleep Shaping is fully covered with professional IICT insurance.

Changes to your baby's sleep or eating arrangements that may be suggested are at your discretion, of which you are responsible for choosing to implement.

The information provided on this website or by HB Sleep shaping is not intended nor is implied to be a substitute for professional medical advice. The Client must always seek the advice of a GP or other qualified healthcare provider with any questions regarding a medical condition or the health and welfare of their baby, toddler or child.

HB Sleep Shaping shall not be liable for any loss or damages (including direct or indirect loss, or special or consequential loss) resulting from the Client's access to, or inability to access, this website, or from the Client's reliance on any information provided on this website or by the consultant.

HB Sleep Shaping owns all copyright in and to the content on this website and the materials, texts, advice, guidance, manuals, and technical information provided to you. The Client may download content only for their personal use for non-commercial purposes, but no modification or further reproduction of the content is permitted. The content may otherwise not be copied or used in any way without express written permission of HB Sleep Shaping or the author of any particular submission.

All materials are provided for non-commercial personal use only. The Client agrees that they will not copy, distribute or adapt the content for any other use, or otherwise compete with HB Sleep Shaping .

HB Sleep Shaping maintains this site for your personal information, education and communication. Please feel free to browse the site. The Client and any visitor to this website may download material displayed on the website for personal, non-commercial use, provided the Client also retains all copyright and other proprietary notices contained on the materials. You may not for any reason, however, distribute, modify, duplicate, transmit, reuse, repost, or use the content of the site for public or commercial purposes, including the text, images, audio, and video without HB Sleep Shaping’ written permission.

Confidentiality and Privacy Policy

The Client acknowledges that HB Sleep Shaping will uphold their case in confidentiality and discretionary.

The Client confirms that they will not share their child’s sleep plan or its content with any third party without HB Sleep Shaping permission to do so. By sharing the plan, it may not be in the third party’s best interest for the child as these plans are customised to each child’s needs.

Information we collect

HB Sleep SHaping will collect typical personal information including name, address, phone number, email address.

HB Sleep Shaping will use the Client's personal information to create an online registration, to record and process their package for general communication. HB Sleep Shaping does not sell or rent personal information to third parties.

Emailing tools

HB Sleep Shaping will communicate with the Client by email, Whats App and may send them Newsletters and other marketing information.

Providing information

The Client agrees that HB Sleep Shaping may provide any personal information it collects about them to its related companies (as defined in section 2(3) of the Companies Act 1993), debt collection and credit reference agencies and any other parties it deems necessary in relation to providing them access to this website, for any services from HB Sleep Shaping, to recover any money they owe to HB Sleep Shaping and to exercise any lawful right HB Sleep Shaping, its related companies or debt collection and credit reference agencies may have. The Client also authorises any person to provide HB Sleep Shaping with such information as HB Sleep Shaping may require in response to credit enquiries.

Severability

If any provision of this Privacy Policy is held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from this Privacy Policy and the remaining provisions shall continue in full force.

Access and removal of information

The Client has the right to access, change and delete personal information that HB Sleep Shaping holds about them. They can exercise this right at any time by emailing barclayhannah1@gmail.com.
